Amend the 2023 Board of Supervisors’ Schedule of Meeting Dates and Locations to reschedule

the June 2023 Budget Hearings for Friday, June 16; and Tuesday, June 20, 2023 if necessary.

A motion was made by Supervisor Nelson, seconded by Supervisor Hartmann, that

this matter be approved. The motion carried by the following vote:

FIRE DEPARTMENT

Consider recommendations regarding Amendment No. 1 to an Agreement with the State of

California for Fire Protection to State Responsibility Area (SRA) Lands, as follows:

a) Approve, ratify, and authorize the Chair to execute the State of California Standard Agreement

Amendment No. 1 (STD 213A) with the State of California Department of Forestry and Fire

Protection (CAL FIRE) for fire protection services to SRA for the period July 1, 2020 through

June 30, 2023 increasing the amount by $3,321,608.00 for a revised total not to exceed

$48,930,148.00; and

b) Determine that the above-recommended action does not constitute a project subject to

environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA

Guidelines Section 15378(b)(4), finding that the action is the creation of a governmental funding

mechanism or other government fiscal activity, that does not involve any commitment to any specific

project which may result in a potentially significant physical impact on the environment.

A motion was made by Supervisor Nelson, seconded by Supervisor Hartmann, that

this matter be acted on as follows:

a) Approved, ratified and authorized; Chair to execute; and

b) Approved.

PUBLIC WORKS DEPARTMENT, BOARD OF DIRECTORS, FLOOD

CONTROL AND WATER CONSERVATION DISTRICT

Consider recommendations regarding a Public Works Director’s Report on Emergency Response

Actions from the Impacts of Flooding and Storms and Continuation of Emergency Actions, as

follows: (4/5 Vote Required)

Acting as the Board of Supervisors and Board of Directors, Flood Control and Water

Conservation District:

a) Receive and review a report from the Public Works Director regarding emergency actions taken

pursuant to Resolution No. 19-327 and Public Contract Code section 22050 related to emergency

operations responding to flooding, storms, debris removal and transportation projects following the

recent storm events and the necessity of the action and the reasons the emergency will not permit

delay resulting from competitive solicitation of bids;

b) Determine that there is a need to continue the emergency actions ordered by the Public Works

Director;

c) Direct staff to return to the Board every 14 days to allow the Board to review the emergency

action and determine whether there is a need to continue the emergency action, by a 4/5 vote, until

the actions are terminated;

Acting as the Board of Directors, Flood Control and Water Conservation District:

d) Determine that these emergency actions were found by the Board to be exempt from the

provisions of the California Environmental Quality Act (CEQA) pursuant to State CEQA

Guidelines Section 15269(c) on January 24, 2023. A Notice of Exemption was filed on this basis

on January 24, 2023, and the proposed action is within the scope of that Notice of Exemption; and

Acting as the Board of Supervisors:

e) Determine that these emergency actions were found by the Board to be exempt from the

provisions of the CEQA pursuant to State CEQA Guidelines Section 15269(d) on February 7,

2023. A Notice of Exemption was filed on this basis on February 7, 2023, and the proposed

action is within the scope of that Notice of Exemption.

A motion was made by Supervisor Nelson, seconded by Supervisor Hartmann, that

this matter be acted on as follows:

Set a hearing to consider recommendations regarding amendment to the Cannabis Business

Licensing Fee Ordinance, as follows:

(Set a hearing for May 16, 2023. Time estimate: 30 minutes)

a) Consider the introduction (First Reading) of an Ordinance amending the Ordinance 5041, “An

Ordinance Establishing the Cannabis Business License Fee”;

b) Read the title and waive further reading of the Ordinance in full; and

c) Set a hearing on the Administrative Agenda of June 6, 2023 to consider recommendations, as

follows:

i) Consider the adoption (Second Reading) of an Ordinance amending Ordinance No. 5041, “An

Ordinance Establishing the Cannabis Business License Fee”; and

ii) Determine for the purposes of the California Environmental Quality Act (CEQA) that:

1) Pursuant to CEQA Guidelines Section 15168(c), these actions are within the scope of the

Cannabis Land Use Ordinance and Licensing Program, and the Cannabis Land Use Ordinance and

Licensing Program Final Programmatic Environmental Impact Report (PEIR)

(17EIR-00000-00003, State Clearinghouse No. 2017071016) adequately describes this activity

for the purposes of CEQA; and

2) Pursuant to CEQA Guidelines Section 15162(a), after considering the PEIR certified by the

Board of Supervisors on February 6, 2018, that no subsequent EIR or Negative Declaration is

required because: i) no substantial changes are proposed which require major revisions of the PEIR

due to the involvement of new significant environmental impacts or a substantial increase in the

severity of previously identified significant effects; ii) no substantial changes have occurred with

respect to the circumstances under which the ordinance is undertaken which require major revisions

of the PEIR due to the involvement of new significant environmental impacts or a substantial

increase in the severity of previously identified significant effects; and iii) no new information of

substantial importance concerning the ordinance’s significant effects or mitigation measures, which

was not known and could not have been known with the exercise of reasonable diligence at the

time that the PEIR was certified, has been received that shows any of the elements of CEQA

Guidelines Section 15162(a)(3) apply.

A motion was made by Supervisor Nelson, seconded by Supervisor Hartmann, that

this matter be set for a hearing, as follows: May 16, 2023 in Santa Barbara (EST.

and Budget Development Workshops, as follows:

b) Provide direction, if any, regarding items to be addressed or included in the County Executive

Officer’s (CEO’s) Recommended Budget, scheduled for release in May and Board adoption

scheduled for June 16, 2023 and June 20, 2023;

c) Provide direction regarding Special Issues, including:

i) Affirmation of priority capital projects recommended for funding;

ii) Use of available discretionary revenues for certain non-cannabis program ongoing and one-time

costs currently funded by cannabis tax revenue; and

iii) Next steps in evaluating revenue tax measures including polling, where appropriate;

d) Provide other direction, if any, as appropriate; and

e) Determine pursuant to California Environmental Quality Act (CEQA) Guidelines 15378(b)(4)

that the above actions are not a project subject to CEQA review, because it is a government fiscal

activity that does not involve any commitment to any specific project which may result in a
