Consider recommendations regarding Amendment No. 2 to the Agreement for Services of Independent Contractor for Maintenance of Revegetation for the Santa Maria River Realignment Project, Fifth District, as follows:

 

Acting as the Board of Directors, Flood Control and Water Conservation District:

 

a) Approve and authorize the Chair to execute Amendment No. 2 to the Agreement for Services of Independent Contractor with Enviroscaping, Inc. (local vendor) for maintenance of revegetation for the Santa Maria River Realignment Project extending the term from January 1, 2025 to December 31, 2026 and increasing the amount by $400,000.00 to a total amount of $670,000.00;

 

b) Authorize an increase of $40,000.00 to the contingency amount of $27,000.00 to a total contingency amount of $67,0000.00 to the Agreement with Enviroscaping, Inc. for additional work needed for maintenance needed for the project; and 

 

c) Determine that this revegetation and maintenance project was found to be exempt from the provisions of California Environmental Quality Act (CEQA) on December 12, 2023, pursuant to State CEQA Guidelines Section 15304 (minor alterations to land) and Section 15601(b)(3) (common sense exemption), and a Notice of Exemption (NOE) was filed on that basis. The proposed contract Amendment No. 2 is within the scope of that NOE and no further CEQA action is required.
