Consider recommendations regarding a Crestwood Behavioral Health, Inc. Fiscal Years (FYs) 2024-2028 Renewal Services Agreement for Champion Healing Center Mental Health Rehabilitation Center (MHRC) Services, as follows:

a) Approve, ratify and authorize the Chair to execute an Agreement for Services of Independent Contractor with Crestwood Behavioral Health, Inc., (not a local vendor), for the provision of in-County Mental Health Rehabilitation Center services, including services to Justice Involved Conservatees, for a maximum contract amount not to exceed $24,730,000.00 inclusive of $6,425,000.00 for FY 2024-2025, $6,610,000.00 for FY 2025-2026, $5,740,000.00 for FY 2026-2027 and $5,955,000.00 for FY 2027-2028, for the period of July 1, 2024, through June 30, 2028;

b) Delegate to the Director of the Department of Behavioral Wellness or designee the authorities listed below, all without altering the maximum contract amount and without requiring the Board's approval of an Amendment of the Agreement, subject to the Board's ability to rescind this delegated authority at any time:

i) Suspend, delay, or interrupt the services under the Agreement for convenience per Section 20 of the Agreement;

ii) Make immaterial changes to the Agreement per Section 26 of the Agreement;

iii) Reallocate funds between funding sources and make changes to the Per Diem Rate and agree to other rates for unspecified special circumstances;

iv) Deny or withhold payment for services for unsatisfactory clinical documentation or non-submission of service data and other information; and

v) Amend the program goals, outcomes, and measures; and

c) Determine that the above actions are government funding mechanisms or other government fiscal activities that do not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment and are therefore not a project under the California Environmental Quality Act (CEQA) pursuant to ...
