Acting as the Board of Directors, Flood Control and Water Conservation District:
 
Consider recommendations regarding Lower Mission Creek Flood Control Project, Reach 1B; Execution of Purchase Contract and Acceptance of Permanent Easement for 118 Chapala, County Project No. SC8042, Second District, as follows:
 
a) Approve and authorize the Chair to execute a Real Property Purchase Contract and Escrow Instructions with Donald A. Campbell and Joy D. Kelly, for the purchase of a permanent easement over a portion of their property known as 118 Chapala Street in the City of Santa Barbara (APN 033-074-011) in the amount of $5,000.00 in connection with the Lower Mission Creek Flood Control Project;
 
b) Accept the Grant of Permanent Nonexclusive Easement by authorizing the Clerk of the Board to execute the Certificate of Acceptance attached to said easement; and
 
c) Find that pursuant to CEQA Guidelines Section 15162, no substantial changes are proposed, and no new information of substantial importance has come to light regarding environmental effects of the project or of the sufficiency or feasibility of mitigation measures, and therefore the proposed execution of the Real Property Purchase Contract and Escrow Instructions, and the acceptance of the Grant of Easement are within the scope of the project covered by the previously-certified EIS/EIR for the Lower Mission Creek Flood Control Project as well as the Findings and Statement of Overriding Considerations accepted by the Board as a Responsible Agency on May 11, 2011, and no new environmental document is required.
