Consider recommendations regarding Professional Services Agreement with CNC Environmental, LLC for the replacement of media within the Landfill Gas Treatment System at the Tajiguas Landfill, Third District, as follows:
a) Approve and authorize the Chair to execute an agreement with CNC Environmental, LLC for replacement of media within the landfill gas treatment system at the Tajiguas Landfill in an amount not to exceed $128,654.00;
b) Authorize the Public Works Director or designee to approve amendments to the professional services agreement with CNC Environmental, LLC in an amount not to exceed $12,865.00 for a total Agreement amount not to exceed $141,519.00; and
c) After considering the Tajiguas Landfill Expansion Project EIR (01-EIR-05) State Clearinghouse Number (SCH) 98041003 certified by the Board of Supervisors on August 13, 2002, the Addendum to 01-EIR-05 dated November 8, 2006 and considered by the Board of Supervisors on December 5, 2006, the Tajiguas Landfill Reconfiguration and Baron Ranch Restoration Project Subsequent EIR (08-EIR-00000-00007) SCH Number 2008021052 certified May 5, 2009 and the Tajiguas Resource Recovery Project Subsequent EIR (12EIR-00000-00002 and Subsequent EIR Revision Letter and Errata) SCH number 2012041068 certified by the Board of Supervisors on July 12, 2016, and Addendum considered by the Board of Supervisors on November 17, 2017, determine pursuant to 14 CCR Section 15162(a) that no subsequent EIR or Negative Declaration is required for this project because: i) No substantial changes are proposed in the project which require major revisions of the 2002 Final EIR, the 2009 Final Subsequent EIR, or the 2016 Final Subsequent EIR and 2017 Addendum; ii) No substantial changes have occurred with respect to the circumstances under which the project is undertaken which require major revisions of the 2002 Final EIR, the 2009 Final Subsequent, or the 2016 Final Subsequent EIR and 2017 Addendum; and iii) No new information of substantial importance concerning the project’s significant effects or mitigation measures, which was not known and could not have been known with the exercise of reasonable diligence at the time that the Final EIR was certified in 2002, the Final Subsequent EIR was certified in 2009, or the Final Subsequent EIR was certified in 2016 and addendum considered in 2017, has been received.
