Significant exposure to civil litigation: 1 case, based on these “facts and circumstances:”

 

 

 

 

 

 

 

On April 20, 2021 the Board of Directors of the Santa Barbara County Flood Control and Water Conservation District (“Flood Control District”):  (1) approved and adopted a Resolution entitled “A Resolution to Approve Water Management Tools Amendment (Amendment 21) to State Water Project Water Supply Contract subject to Certain Limitations to Maintain Local Water Supply” that establishes conditions of use of Amendment 21 to protect and secure water supplies for the entire County; and (2) approved and authorized the Public Works Director to sign and execute Amendment 21 with the State of California and return to the Board with any such transactions involving a sale of State Water outside the County, only after such conditions set forth in the above Resolution are met.

 

On May 7, 2021, a Director of the Goleta Water District contacted Flood Control District Staff, stated that the Goleta Water District planned in Closed Session on May 11, 2021 to discuss a decision to initiate litigation against the Flood Control District, concerning the Flood Control District’s actions with Amendment 21, and sought more information about the Flood Control District’s positions about Amendment 21.  The published agenda for the May 11, 2021 meeting of the Goleta Water District’s Board of Directors included a Closed Session item about deciding whether to initiate litigation.
