Title: Consider recommendations regarding a request for Waiver on Competition in the Purchase of a Proprietary Aerated Static Pile System at the Tajiguas ReSource Center, Third District, as follows: a) Authorize the Purchasing Agent to waive competitive bidding to procure a proprietary covered aerated static pile compost system (SG MOBILE(r) System with GORE(r) Covers) for the Public Works Department from Sustainable Generation, LLC, not a local vendor, in an approximate amount of $4 million; and b) Authorize the Purchasing Agent to advance a deposit of $100,000.00 to Sustainable Generation, LLC in order to secure an order for the manufacture of the GORE(r) covers; and c) Determine that the proposed actions are not a "project" under the California Environmental Quality Act pursuant to Section 15378(b)(2), as it involves administrative and other general policy and procedure making activities that will not result in direct or indirect physical changes to the environment.
